A recent incident involving Phoenix police officers and Tyron McAlpin, a Black, deaf man with cerebral palsy, has prompted Phoenix Councilman Kevin Robinson to issue a statement emphasizing the importance of transparency and accountability.

The arrest, which has stirred concerns within the community, aligns with broader issues highlighted in the Department of Justice’s (DOJ) recent report on the Phoenix Police Department.

 

Overview of the Incident

On August 19, 2024, Phoenix police officers Benjamin Harris and Kyle Sue arrested Tyron McAlpin during what the officers described as a routine encounter. Body camera footage, however, has raised serious questions about the officers’ actions.

The footage shows the officers:

  • Punching McAlpin in the head at least 10 times
  • Tasering him four times
  • Wrapping their arms around his neck

The officers claimed McAlpin was attempting to flee, taking a fighting stance, and ignoring commands. However, McAlpin’s attorneys argue that these claims do not match the video evidence, stressing that McAlpin could not comply due to his hearing impairment and physical disabilities.

McAlpin currently faces charges of aggravated assault and resisting arrest. The Maricopa County Attorney, Rachel Mitchell, has promised a personal review of the case due to the public’s heightened attention.

 

Councilman Kevin Robinson’s Response

Councilman Kevin Robinson, addressing the community’s concerns, highlighted the need for a thorough and swift investigation. He stressed that the footage had indeed raised significant questions, reinforcing the need for transparency.

Robinson noted,

“It’s crucial that our city’s police department ensures allegations of misconduct are fully examined.”

He reiterated his commitment to holding the department accountable and ensuring it operates with integrity.

In his statement, Robinson also referenced the DOJ’s recent findings, which called for consistent processes in investigating police misconduct. He stated that this incident provided an opportunity for the Phoenix Police Department to demonstrate its dedication to constitutional policing.

 

Ongoing Police Reform Efforts

Councilman Robinson, alongside Mayor Kate Gallego and District 8 Councilwoman Kesha Hodge Washington, has actively pushed for reforms within the police department. In a memo to the City Council on September 24, 2024, they proposed several measures, including:

  • Setting clear deadlines for investigations
  • Expanding training for officers, particularly in de-escalation tactics
  • Reviewing officers’ conduct and decision-making during incidents involving vulnerable populations

These reforms were unanimously approved by the City Council and represent an ongoing effort to address systemic issues and improve the Phoenix Police Department’s interactions with residents.

 

Broader Context: The DOJ Report

This recent incident comes two months after the DOJ released a report on systemic issues within the Phoenix Police Department. The report highlighted several areas of concern, including racial bias, excessive force, and misuse of tactics like Tasers and chokeholds.

It also noted the department’s challenges in protecting the rights of people with disabilities. The DOJ’s findings have since fueled public debate about whether federal oversight is necessary to bring about meaningful change.

As the investigation unfolds, the Phoenix City Council is committed to keeping the public informed about developments. Councilman Robinson underscored the need for clear communication with residents, assuring that they would receive updates as more information becomes available.

The city’s leaders also plan to continue collaborating with the DOJ to implement reforms aimed at preventing similar incidents in the future.

Robinson concluded his statement by expressing his hope that the investigation will demonstrate the city’s commitment to transparency and accountability, reinforcing his dedication to building trust between the police department and Phoenix residents.

“Like many Phoenix residents, I have seen the footage of the police interaction involving Tyron McAlpin.   While I cannot comment on the specifics of this case as the investigation is still ongoing, the footage, on its face, is very concerning.   A full investigation is underway, and I expect it to be comprehensive with clear and detailed findings, analysis, conclusions, and recommendations.

This incident unfortunately reignites distrust in our community.  As a city, we must take into account how to rebuild and maintain community trust, which is essential for the effective functioning of our institutions.

Last month, I joined Mayor Kate Gallego and Councilmember Kevin Robinson in proposing specific policy recommendations geared at increasing transparency, accountability, and correcting lapses in the public safety system.  I remain committed to working with my colleagues, law enforcement, and community members to ensure that we continue to craft and implement policies that are just, equitable, and protect the safety of every resident.”
