A significant court decision has reinforced the closure of the Eastchurch waste site, known locally as Eastchurch Gap, to combat persistent illegal waste dumping. This move by the Environment Agency aims to safeguard both the local community and the environment, addressing long-standing concerns over the site’s misuse.

 

Continued Court Order

Protecting the Community

The Environment Agency has successfully extended a court order to maintain the closure of the Eastchurch site, a decision made in response to the local community’s concerns and the environmental damage caused by illegal waste tipping.

Matt Higginson, Environment Manager for the Environment Agency in Kent, emphasized,

“Our priority is protecting the local community and environment. This order has been secured following the local community’s concerns and the environmental impact of the tipping of waste at the site.”

 

Enforcement and Penalties

Strict Measures in Place

The court order, under the Environment Act 1995, prohibits site entry or waste depositing without permission or reasonable excuse. Violations of this order constitute a criminal offence, which can lead to severe penalties, including prison sentences.

The Environment Agency regularly inspects the site and maintains a presence in Eastchurch to disrupt illegal waste activities.

  • Court Order Extension: The previous restriction order, obtained on 30 June 2023, has been extended for a further 6 months until 20 June 2024.
  • Legal Consequences: Failure to comply with the order is a criminal offence, with potential penalties including prison sentences.
  • Regular Inspections: The Environment Agency conducts regular inspections and maintains a presence in Eastchurch to prevent illegal waste dumping.

 

Tackling Waste Crime

The Environment Agency’s efforts to combat waste crime have been substantial. By the end of the 2022/23 financial year, they stopped a total of 458 illegal waste sites and brought 94 prosecutions against companies and individuals, resulting in fines exceeding £6 million.
