Kaba Ltd. of Tiverton is facing a significant financial penalty for failing to comply with packaging waste regulations. After an investigation by the Environment Agency, the company has agreed to pay £24,100 to the Devon Wildlife Trust as part of an Enforcement Undertaking, a legal agreement to avoid prosecution.

Kaba Ltd’s Long-Standing Non-Compliance

Kaba Ltd, located on the Tiverton Business Park, specializes in security access systems. However, for 18 years, the company failed to register or adhere to the UK’s packaging waste regulations.

The Environment Agency’s investigation revealed that Kaba Ltd did not take the necessary steps to ensure their waste was properly recovered and recycled from 2001 to 2018.

The fine imposed reflects the financial savings Kaba Ltd accumulated by neglecting these regulations, plus an additional ten percent penalty.

As part of the resolution, the company has also committed to new compliance procedures, including registration with a packaging compliance scheme, and will cover the Environment Agency’s investigative costs.

 

Contribution to Devon Wildlife Trust

The £24,100 payment by Kaba Ltd will support the Devon Wildlife Trust’s North Devon Natural Solutions project.

This initiative works with over 360 farmers and landowners, offering workshops, webinars, and practical training to enhance riverbank protection, create new wildlife habitats, regenerate woodlands, and establish wild areas.

The project plays a crucial role in preserving the natural environment across North Devon, making Kaba Ltd’s contribution both significant and beneficial.

 

Emily Glendenning of the Environment Agency commented,

“The company should have been well aware of their responsibilities over packaging waste. We won’t hesitate to take action where companies are not complying, but it’s good to see a local environmental charity will benefit.”

 

Understanding Enforcement Undertakings

An Enforcement Undertaking is a voluntary agreement between an offender and the Environment Agency, offering an alternative to prosecution. It requires the offender to:

  • Rectify the impact: Address the environmental harm caused by their actions.
  • Compensate third parties: Make reparations to those affected by their non-compliance.
  • Prevent future offences: Implement measures to avoid future breaches.

If accepted by the Environment Agency, this agreement becomes legally binding, ensuring the offender adheres to all conditions outlined.

 

Waste Management in Devon

Devon County Council oversees numerous household waste recycling centers (HWRCs), with a strong focus on recycling and waste reduction.

Currently, there are 19 HWRC sites, boasting an average recycling rate of 74%. Future plans include developing modern recycling sites to enhance waste management further.

Kaba Ltd’s case serves as a reminder to all businesses about the importance of environmental compliance. By failing to adhere to regulations, companies not only risk financial penalties but also damage their reputation within the community.
